  1.               CALLSTAT Liscense Agreement and Order Form

  4.       CALLSTAT is Copyrighted by James R. Davis as of December 1991 and
  5. is covered by US and International Copyright laws.  The author reserves
  6. all rights.
  7.  
  8. Liscense:
  9.  
  10.    You are granted a limited liscense to use CALLSTAT for a thirty (30)
  11. day period for the purpose of evaluating it for your own use.  After
  12. thirty days, you are required to either register CALLSTAT or stop using
  13. it. To continue using it is a violation of copyright laws and just not a
  14. nice thing to do..

  16.    The Shareware version of CALLSTAT is NOT crippled in any way.  There
  17. are no missing features or timers.  The only differences between the
  18. registered and unregistered versions of CALLSTAT are, the Shareware
  19. version places the word "UNREGISTERED" in the bulletin and displays the
  20. UNREGISTERED logo on the computer screen as part of the copyright
  21. notice.

  23. BBS Distribution:
  24.  
  25.    BBSs are granted a limited liscense to distribute CALLSTAT in a
  26. compressed format.  The distributing BBS is not limited to the type of
  27. compression method used for distribution.  However, the BBS must follow
  28. the following guidelines:
  29.  
  30. 1. If CALLSTAT is distributed in a ".ZIP" file, the BBS must do it's
  31.    best to preserve the "AV" that CALLSTAT was compressed with by the
  32.    author.  If a BBS wishes to have CALLSTAT sent to them directly
  33.    from the author, please contact the author and a copy will be sent
  34.    either by US Mail, or uploaded directly to the BBS.  The sole
  35.    exception to distribution of CALLSTAT without the security "AV"
  36.    placed by the author is where a BBS uses a program to validate their
  37.    uploads that, as a part of validation, reZIP's the file for maximum
  38.    compression (not necessary since the distribution archive from the
  39.    author is created with maximum compression enabled).
  40. 2. No BBS may, in re-ZIPing CALLSTAT, add to the ".ZIP" their own "AV"
  41.    which does not belong to the author.
  42. 3. No BBS is authorized to add any files to the archive which are not
  43.    part of the original CALLSTAT archive as distributed by the author.
  44.    The sole exception is where a BBS adds an ASCII text file (containing
  45.    no ANSI codes of any type) as an advertisement, and the filename for
  46.    the file has not and/or will not change, and the BBS does not "cycle"
  47.    filenames for the purpose of "fooling" upload checking programs from
  48.    other BBSs which remove such advertisements.
  49. 4. No user may be charged any additional fee just to download CALLSTAT
  50.    from the BBS.

  52. Shareware Vendor Distribution:
  53.  
  54.    This copyrighted software and its documentation is NOT PUBLIC DOMAIN.
  55. However, CALLSTAT may be distributed at no charge, or for a charge not to
  56. exceed $12 US to cover shipping and media costs.  When secondarily
  57. distributed, CALLSTAT must be in its original compressed form and
  58. accompanied by its full documentation.  The distributed software and
  59. documentation may not have been modified in any way.

  62.    No secondary distributor is authorized to "register" an individual
  63. copy of CALLSTAT.  Registration fees may only be sent directly to the
  64. author as outlined in the manual on disk.  Note that the registration fee
  65. is exclusive of, and over and above any fees that may have been charged by
  66. a secondary distributor.
  67.  
  68.    A secondary distributor must notify it's customers that CALLSTAT is a
  69. shareware program and that the fee payed by their customer does not include
  70. any fees owed the author for use of this program.
  71.  
  72.    A secondary distributor must notify the author of their intention to
  73. include this group of files in their distribution.  A secondary distributor
  74. may be granted exceptions to these conditions, only in writing from the
  75. original author.

  77.    The author reserves the right to change any of these conditions without
  78. notice and any changes become retroactive.  Failure to abide by this liscense
  79. agreement may result in either Civil Lawsuit or Criminal charges being filed.

  84.    Registration:

  86.       Once you have registered CALLSTAT, you are eligible to recieve all
  87.       future versions of CALLSTAT for no additional upgrade fee beyond
  88.       any necessary shipping charges.
  89.  
  90.       Multi-node systems do not need to register one copy for each node,
  91.       instead, we charge just a $5 fee which covers from 2 to unlimited
  92.       number of nodes.

  94.    Shipping and Handling:

  96.       All orders REQUIRE a shipping and handling charge as shown below. 
  97.       These charges cover our costs in shipping your order and tracing
  98.       delivery problems.

  105.       Once your order has been recieved and processed, you will be mailed
  106.       a letter containing your serial number and instructions for using it
  107.       in your configuration file.

  109.       Orders typically require 3 - 4 business days processing time before
  110.       shipment, and may take more or less depending on our order backlog.
  111.       US standard shipping is via UPS Ground, via US Priority Mail where
  112.       UPS delivery is impossible (PO Boxes, Alaska, Hawaii, and APO / FPO
  113.       addresses), and via First Class Mail for diskette-only orders.  US
  114.       2-day shipping is via UPS Blue Label.  All shipping outside the US is
  115.       via Air Mail.  Shipping time varies from 1 business day for UPS
  116.       Ground to New England, to 6 business days for UPS Ground to California,
  117.       to several weeks for countries outside the US where mail service
  118.       is slow.  Express shipping via UPS Red Label or Federal Express is
  119.       available; contact us for rates.

  121.    Payment Terms:

  123.       Personal checks may be subject to a bank clearance delay before
  124.       shipment.  All payments must be made in US funds and drawn on a US
  125.       bank; see below for more details on international orders.  There
  126.       is a $7 charge for all returned checks.

  130.       We are happy to accept orders from outside the US, but must require
  131.       payment in the correct form to avoid the exorbitant fees charged by
  132.       US and non-US banks for international check collections.

  137.              Checks which are not in US funds and drawn on a US bank must
  138.              unfortunately be returned to you, resulting in significant
  139.              delay in processing your order and additional expense to
